Important Information The property is illegally occupied by third parties and lacks properly contracted utilities. The Property will be transferred: (i) as a specific certain body and for a lump sum, (ii) as an inseparable whole, (iii) in its current registry and cadastral state, (iv) in its current physical condition, quality, legal, town planning, administrative, licensing, protection, conservation, and cleanliness status, (v) up to date with the expenses and taxes corresponding to the Seller by law, and (vi) without the provision of services and utilities. The Buyer will assume: (i) the physical situation and state of conservation, (ii) the town planning situation, (iii) any discrepancies between the physical reality and the registry and cadastral reality, or in the capacity of the Property, (iv) the registry and cadastral alignment of the Property, and (v) the procedures required to obtain Judicial Possession of the Property. The Owner will not be responsible for: (i) the state of conservation, (ii) visible and apparent defects, (iii) registry or cadastral regularization, (iv) discrepancies in area size that may exist, (v) responsibility for obtaining the certificate of occupancy of the Property, unless its delivery is mandatory in the Autonomous Community where the Property is located, and (vi) any costs, expenses, fees, tariffs, or taxes derived from the foregoing. If, at the date of sale, the Owner has legally sued regarding the occupation, the buyer may subrogate into said lawsuit, being unable to claim any amount from the Owner as a consequence, except for the fees of lawyers and court representatives accrued up to the date of transfer, which will be borne by the buyer in any case. If, at the date of sale, the Owner has filed a criminal complaint that is ongoing, the sale will be communicated to the Court, and the Owner will withdraw from the proceedings as a private prosecutor. The state of occupation and/or the obstacles preventing the property from being freely visited by technicians would prevent: i) its official valuation as required by Order ECO/805/2003, of March 27, meaning the property cannot be mortgaged as long as the occupation situation persists; consequently, mortgage financing cannot be established on this type of estate, the acquisition of which will require providing other types of guarantees if financing is requested, and ii) the owner from obtaining the energy efficiency certificate. The sale price of this Property has been determined based on the aforementioned circumstances, which have resulted in a lower value, and which must be expressly accepted by the buyer upon formalizing the transfer of the Property. It is recommended that the buyer obtains professional and legal advice before making the purchase decision.
